The Arizona State Legislature is the bicameral legislature of the State of Arizona. It is composed of a 30-Member upper house called Senate and a 75-Member lower house styled House of Representatives. Both Houses of the Legislature meet in the Arizona State Capitol in Phoenix, the State capital: The Senate meet in the Hall of the Senate, located on the south side of the building, while the House of Representatives meet in the Hall of Representatives, which is located on the north side of the Capitol. Members of both Houses of the Legislature are chosen by direct, popular election; however, the Manner and Method of electing Members of the Legislature varies between the Senate and the House of Representatives.

The Legislature has 105 Members: 30 Senators and 75 Representatives.

The thirty Members of the Senate are chosen by the qualified Electors in and of each of the fifteen Counties to a Term of six Years (renewable once consecutively). Elections for Senators are staggered so that the Seats of one-third of the Senate (10 Senators) are filled every two Years. In choosing them, the Electors in each County choose between one and three Senators to represent the People of their County in the Senate; more populous Counties elect more Senators: However, each County is entitled to at least one Senator.

On the other hand, Members of the House of Representatives serve a Term of two Years (renewable twice consecutively) representing the People of their District: There are forty-five Constituencies: thirty District-based Constituencies and fifteen County-based Constituencies; and of the Representatives chosen to sit and speak on behalf of the People, of the respective District constituencies the Electors therein send from among their Number two Representatives, and of the respective County constituencies the Electors therein send from among their Number one Representative.

Powers of the Legislature[edit | edit source]

All legislative Powers of the State are vested in a Legislature, consisting of a Senate and House of Representatives, and in the People directly via the Powers of Recall, Referendum and Initiative. As for the Arizona State Legislature, it is bicameral, consisting of two, directly-elected chambers; an upper house by the name of Arizona State Senate, with its 30-members elected on a county-basis; and a lower house by the name of Arizona House of Representatives, with its 60-members elected in thirty, two-member districts.

Overview of legislative power[edit | edit source]

Under Arizona’s constitutional framework, the legislative Power is the more dominant of the three branches (the other two being the executive and the judicial).

Checks and balances[edit | edit source]

The Arizona Constitution vests State power in three branches of Government, the lawmaking Power is vested in the Legislature (and also in the People directly via the Referendum and Initiative powers); the administrative and law-enforcing Power is vested in the Executive; and the Power of applying and interpreting the law, and ensuring the correct application of the Constitution and constitutional Principles, is vested in the Judiciary. No branch of government may exercise any of the Powers belonging to the other two. However, the State Constitution does establish a system where each branch is able to check and balance the other two in order to restrain each branch from becoming too powerful. For instance, while the Legislature passes bills, they cannot become law without the Governor’s approval (or, if he does not approve, then with the subsequent re-passing of the bill by two-thirds of the Members elected to each House of the Legislature). Additionally, the Governor executes (carries out) Laws passed by the Legislature; and his Treaty-making power is dependent on the approval (“Advice and Consent”) of the Arizona Senate. Furthermore, while the Legislature makes the law, and Governor ensures that it is dutifully carried out, the Judiciary internets the Law and makes sure that all Laws are in compliance with the Constitution, striking down those that are unconstitutional. Finally, the Legislature is not the only law-making Power in the State: Via the Initiative power, the People themselves can enact or repeal legislation at the Polls, independently of the Legislature; they can also remove problematic Officials in any of the three branches via the Recall power; and can order legislatively-passed bills to the Polls for the People to decide on via the Referendum power: Additionally, these three direct-democracy Powers also exist at the County and Municipal levels of Government in Arizona.

Structure[edit | edit source]

The Arizona State Legislature is bicameral (consisting of two chambers): a 30-member upper house known as the Arizona State Senate, and a 60-member lower house known as the Arizona House of Representatives. Both the Senate and House of Representatives are directly-elected by the People, but the members of each chamber are elected in different Manners: Members of the Senate are chosen on a county-basis, where the People in each County choose between one and three Senators, and more populous Counties choose more Senators; and Members of the House of Representatives are chosen among the thirty Legislative Districts, where the People in each District elect two Representatives to sit in the House of Representatives. Senators serve Terms of six Years, renewable once consecutively; and Representatives for Terms of two Years, renewable twice consecutively.

In case of a vacancy in either the Senate or House of Representatives, a replacement is chosen by the Board of Supervisors of the County in which the District is located (if the District spans more than one County, then boards of supervisors of the affected Counties assemble in a single session and choose the replacement): However, the replacement must be of the same political Party as the incumbent in whose seat the vacancy exists. As Senators are chosen on a county-basis, with each County counting as a single Senate district, only the Board of Supervisors of the affected County is involved in choosing a replacement for that Senate seat. In all cases, the replacement serves the remainder of the Term to which the original incumbent was elected.

Each House of the Legislature is divided into committees, each of which focus on a specific sector of government. This allows for specialization in each area that would otherwise be impossible for the whole membership of that house to attempt to specialize on all matters of government. By dividing their membership into committees, this allows for each committee to become experts in their area of focus and the related agencies they oversee.

Sessions[edit | edit source]

While each Legislature spans a period of two Years, a session spans one. Each session begins the second Monday of January and adjourns sine die on or before the last Friday in July. However, the Governor may at any time call the Legislature into special session, during which the Legislature may only consider those matters specified by the Governor in his Proclamation calling the special session.

Joint sessions[edit | edit source]

A joint session is where the Senate and House of Representatives meet together as a single body. This only occurs in special situations, such as for the Governor’s annual State of the Republic address to the Legislature.

Bills and resolutions[edit | edit source]

The Arizona State Legislature is responsible for making Laws in the State of Arizona. The first step in the legislative Process is Bill drafting. First, Legislators must submit a Bill request to the Legislative Council staff. Additionally, a Legislator-elect may submit a Bill request or private Citizens can obtain authorization from a Legislator to use the Legislator’s name before giving instructions to the Legislative Council staff. The Legislative Council staff delivers a Bill draft to the sponsor or requester and, if directed, will prepare the Bill for introduction.

Bills undergo three or four Readings during the legislative Process. After the first Reading, they are assigned to Committee. Committees can amend Measures or hold Legislation and prevent it from advancing. Once Committee action is completed, the Bill undergoes a second Reading and, just before a floor Vote on the Bill, a third Reading. If that House approves the Bill, it is then sent to the opposite House of the Legislature for consideration. If approved, without Amendment, it is then sent to the Governor for his approval or disapproval. If, however, one House of the Legislature amends the Bill, the other House may either reconsider the Bill with Amendments or ask for the establishment of a Conference Committee to work out differences in the different versions of the Bill passed by each House of the Legislature. Once a piece of Legislation approved in identical form by both the Senate and House of Representatives is forwarded to the Governor, the Governor may either approve or disapprove of it —If he approves, he shall sign it, and it shall become Law on the effective date specified in the Bill; but if not, he shall not sign it and return it, together with his Objections, to the House of the Legislature in which such Bill shall have originated, who shall enter the Objections at large on their Journal, and proceed to reconsider it. If after such Reconsideration, two-thirds of that House of the Legislature shall agree to pass the Bill, it shall be sent, together with the Objections, to the other House, by which it shall likewise be reconsidered, and if approved by two-thirds of that House, it shall become Law: If, in reconsidering the Bill, the Legislature fail to approve it in each House by two-thirds of the Members thereof, respectively, the Bill shall not become a Law.

The Senate shall be composed of a Number of Members, chosen by the Electors of the State in each County, and the Number of Senators chosen in each County shall be apportioned in the following Manner; that is to say:
  • Counties with a population of thirty thousand or less shall be entitled to one Senator;
  • Counties with a population of more than thirty thousand but less than five hundred thousand shall be entitled to two Senators;—And
