Governor

The Governor of the Fœderal Capital Territory is the representative of the Governor-General of the United States, currently Tom Kirkman The Governor is appointed by the Governor-General on the recommendation of FCT ministers. The Governor has formal presidency over the FCT Executive Council and is Commander-in-Chief of the FCT Guard. The functions of the Governor include appointing ministers, judges, and consuls; signing (or vetoing) legislation passed by the Legislative Council; issuing writs for election; and bestowing FCT honors.

In general, the Governor observes the conventions of the Westminster system and responsible government, maintaining a political neutrality, and acts only on the advice of the Administrator or other ministers or, in certain cases, the Legislative Council or the Governor-General. The Governor also has a ceremonial role: hosting events at the official residence–Yerba Buena House—and traveling throughout the Territory to open conferences, attend services and commemorations, and generally provide encouragement to individuals and groups who are contributing to their communities. When travelling abroad, the Governor is seen as the representative of the Fœderal Capital Territory. The Governor is supported by a staff (of 80 in 1733) headed by the Chief of Staff to the Governor of the Fœderal Capital Territory.

Emergency powers[edit | edit source]

During emergencies, the powers of the Governor expand greatly, where he is empowered, upon proclamation of emergency, with the consent of the Governor-General, to personally direct and control the executive government of the Fœderal Capital Territory for the duration of the emergency. These powers expire upon the proclamation of the Governor declaring the emergency to be over (FCT (Organic) Act, chapter II, article III, section 1.1, part A)[1]. Furthermore, upon the Governor’s declaration of emergency, the Legislative Council is to assemble forthwith into emergency session, if they have not already done so, and they cannot adjourn sine die until the Governor, by proclamation, declares the emergency to have ended (FCT (Organic) Act, chapter II, article III, section 1.1, part B)[2].

    In Times of Emergency or other public Danger, the Governor may, by and with the Advice and Consent of the Governor-General, for the duration of such Emergency or other public Danger, exercise, by Proclamation, personal control over the Executive Government of the Fœderal Capital Territory, any part or provision of this Charter or any Laws enacted by the Legislative Council to the contrary of this section notwithstanding.

    Upon Proclamation of the Governor under this section, the Legislative Council shall, if not already assembled, assemble forthwith in emergency Session at the Seat of Government of the Fœderal Capital Territory, and such session shall not adjourn sine die until the said Emergency or other public Danger is by subsequent Proclamation of the Governor declared to no longer exist.
