United States federal agencies are the various Federal-level Departments, Bureaus, Offices, and other governmental Bodies of the United States. These entities are divided among the four constitutional Departments, or Branches, of the United States Government: Those Agencies of a legislative Nature are housed in the legislative Department and overseen by the United States Congress; those that are of an executive or administrative Nature are housed in the executive Department and overseen by the Governor-General of the United States; those that are judicial in type are contained within the judicial Department and overseen by the United States Supreme Court; and those that are intergovernmental in function are found within the intergovernmental Department and overseen by the United States Federal Council. Under the system of the United States' constitutional Law, all four constitutional Departments (branches: legislative, executive, judicial, and intergovernmental) are co-equal with one another.

While the Governor-General is the de jure Head of Government and the Federal Council is de jure the Head of State[a], the Governor-General, in performing as the representative of the Head of State (the Federal Council collectively), is the de facto the Head of State, as well as Head of Government.

Agency types[edit | edit source]

There are three types of Federal Agency: Institutions, Authorities, and Departments. Each is distinct in its own right. Institutions are those directly established by self-executing provisions of the United States Constitution; Authorities are Agencies established by and under the United States Federal Council; and Departments are executive Agencies established by the United States Congress and subjected to the control, supervision, and direction of the Governor-General.

An important distinction in United States Governmental terminology is made between the words, “Federal” and “Fœderal”: The former is used to describe Agencies established under the authority of Congress; while the latter is used to refer to those Agencies established under the authority of the Federal Council —Departments are All-Union in scope and effect, while Authorities are Intergovernmental in their constitution and function.

Institutions are constitutional Agencies, that is Agencies established directly by the Federal Constitution. These Agencies are the United States Congress and its components, the United States Senate and the United States House of Representatives; the Office of Governor-General; the United States Supreme Court; and the United States Federal Council. Each of these Institutions fall within four branches, or “[constitutional] Departments” of the Federal Government: The Federal Council (including its dependent Authorities) fall within the Intergovernmental Department; the United States Congress (including the United States Senate and United States House of Representatives) are contained within the Legislative Department; the Governor-General and Cabinet agencies are housed in the Executive Department; and the Supreme Court and other Federal-level Courts come within the Judicial Department. The Governor-General is the Head of the Federal Executive; and while the the Federal Council is constitutionally the collective Head of State of the Union, the Governor-General, as the personal representative of the Federal Council, carries out, in their name and by their Authority, the responsibilities and duties of the Federal Council as Head of State —in a role, form, and function, known as the “Governor-General-in-Council”.

Authorities[edit | edit source]

Authorities are Agencies established by and under the United States Federal Council, and at the helm of each of these agencies is a Superintendent, who is the Head and principal Officer of such Agency.

Authorities are established by Statute, under U.S. Const., article II-B, section 8, part B; meaning that while the Congress passes the legislation, the Federal Council is responsible for approving said legislation: In practice this means that, while the Governor-General is the actual Officer who signs this type of Bill into law, he cannot do so without the “Advice and Consent” of the Federal Council –The signature of the Governor-General in this case is not an expression of his own approval but that of the Federal Council.

Departments[edit | edit source]

Departments are the primary executive Agencies under the control of the Governor-General, and the Head and principal Officer of each Department is an United States Secretary. There are eight Departments (State & Foreign Affairs, Attorney-General, Public Safety & Civil Defense, Military & Naval Affairs, Treasury, Interior, Administration, and Post Office); and of these, the Department of the Attorney-General and the Department of the Post Office are headed by the United States Attorney-General and United States Postmaster-General, respectively; and of the remaining six, each of them, respectively, is headed by the relevant United States Secretary responsible for the portfolio specific to the Department.

Departments, like Authorities, are established by Statute and not by the Constitution. However, unlike Authorities, Departments are established under U.S. Const., article II-B, section 8, part A; meaning that while the Congress passes the legislation, the Governor-General is the only Officer responsible for approving (signing) said legislation into Law.

The United States Federal Council is the collective Federal head of state of the United States, composed of the thirty State Governors and the Governor-General of the United States, or their respective designees. The U.S. Constitution designates that the Governor-General of the Union is, by virtue of his office, also President of the Federal Council. Unique to the United States, during state visits, it is unusual for the whole Federal Council to be present at the same time to formally receive the foreign dignitary: Instead, the Federal Council, by their standing rules, have vested this responsibility in the Governor-General.

    The Governor-General of the United States is the Federal head of government of the United States. The Office of Governor-General is an indirectly-elected Post, by which the Governor-General is formally chosen by an electoral college consisting of a Number of Electors from each State chosen by the Voters thereof, with the Number of Electors to which each State is entitled being equal to its Representation in both Houses of Congress.

    As, except where the United States Constitution directs otherwise, all executive Power of the United States (the Union) is vested in the Governor-General, the person holding this Office is the head of the Federal Executive Department; and all employees of the executive Department serve at his pleasure.

    Article II-C of the United States Constitution vests the executive power of the United States in the Governor-General. However, in practice, the Governor-General delegates authority to exercise this Power to his subordinates; that is to say the Heads of Departments, federal executive Agencies, and, most importantly, to the States. Article II-C also establishes that the Governor-General shall be assisted by a Federal Cabinet (FedCab) which is composed of the Heads of the principal executive Departments and the FedCab-level Officers. The Governor-General is president of the Federal Cabinet.

    The United States Federal Government does not have a post for lieutenant governor-general. Instead, the Federal Constitution prescribes that, “[i]n Case of the Removal of the Governor-General from Office, or of his Death, Resignation, or Absence from the United States, or Inability to discharge the Powers and Duties of the said Office, the Same shall devolve on the President of the Senate”[1] —In other words, as the Governor-General’s lieutenant, whenever the Governor-General is unable to exercise the Powers and Duties of his Office, the President of the Senate is to exercise the Powers and Duties of the Office of Governor-General as Governor-General pro Tempore[2] “until the Disability be removed, or a Governor-General shall be elected and qualified”.[1] The President of the Senate, therefore, performs an equivalent role to that of a Lieutenant Governor in United States politics.

    The Department of State and Foreign Affairs is an executive department of the U.S. Federal government responsible for the Union’s foreign policy and international relations. The Department is also responsible for the Union’s intergovernmental relations, that is relations with the respective States that comprise the Union. In its function relative to the former, the Department of State and Foreign Affairs is equivalent to the ministry of foreign affairs of other nations, and in this capacity its primary duties are advising the U.S. Governor-General, administering diplomatic missions, negotiating international treaties and agreements, and representing the U.S. at the United Nations. In its functions relative to the latter, the Department of State and Foreign Affairs is equivalent to the ministry of intergovernmental affairs that may be found in some federal or quasi-federal nations; and in this capacity its primary duties are advising the U.S. Governor-General on Federal government matters that may affect the States, in and for each State representing the Governor-General to the State Governor, administering the various United States Offices in each of the thirty States, negotiating intergovernmental treaties and agreements with the various States, representing the Governor-General at the certain configurations of the Federal Council, and representing the States severally at the United Nations. The Department is headquartered in the Jefferson Complex, in the Fort Mason neighborhood of the Fœderal Capital Territory; “Fort Mason” is thus sometimes used as a metonym.

    The Department of State and Foreign Affairs is headed by an United States Secretary for State and Foreign Affairs, usually shortened as “Secretary of State”, and sometimes referred to as the “Secretary-General of the United States”, who is the “the principal assistant to the Governor-General in all matters relating to the Department of State and Foreign Affairs.”

    The Department of the Attorney-General is a Department of the United States Federal Executive, responsible for interpreting the United States Constitution and Federal Law in the form of Attorney-General Opinions, which have the force of Law unless and until reversed, either by the Supreme Court, or by the Judicial Committee of the Federal Council; and serving as the legal counsel for the Government of the United States. Other responsibilities of the Department include monitoring State-enforcement of Federal Law, advising States on Matters relative to enforcing Federal Law, and representing the United States in the U.S. Federal Court, the U.S. Supreme Court, and also in the Courts of the various States whenever there arises a question of Federal Law, or the United States Government (or an officer or employee thereof, when acting in their official capacity) has an interest or is otherwise a Party.

    The Attorney-General is the “the principal assistant to the Governor-General in all matters relating to Federal Law and the Department of the Attorney-General,” and mainly serves as the legal counsel to the Federal Executive and the various Branches, Departments, Agencies, and Offices thereof. In addition, the head of the Department, the Attorney-General of the United States, represents the Federal Government before the Supreme Court, and occasionally in State-level Courts in Causes (Cases or Controversies) involving federal Officers or Questions of Federal law. However, in most Cases arising in a State-level Court that involves the United States, or an Officer thereof (when acting in their official capacity), or a Federal-question, the Union is usually represented in Court by the U.S. Attorney in and for that State, or his deputy. The Department, by Law, also monitors the States in their enforcement of Union (Federal) law, including their prosecuting of violations of Federal law; and regularly offers nonbinding guidance to State attorneys-general on Matters relative to their State’s enforcement of Union law.

    The Department of Public Safety and Civil Defense is the department of the United States Federal Executive with responsibility for protecting the United States and their respective peoples from external and interstate threats; and also responsible for the United States’ (federal) domestic and foreign Intelligence and counterterrorism Efforts. However, under the United States Constitution, most federal Intelligence and other Federal public safety Agencies, their Officers and Employees, are forbidden from carrying Weapons as part of their Duties while within the United States, and, likewise, the Officers of most of those Agencies are further prohibited from arresting or detaining Persons: Instead, the majority of Federal Intelligence and Federal public safety Agencies may only collect Intelligence, Investigate, and Observe; and then forward their findings and recommendations to State-level law Enforcement and State/Federal Prosecutors.

    The Department of Public Safety and Civil Defense is headed by an United States Secretary for Public Safety and Civil Defense, sometimes referred to as the “Sheriff-General of the United States”, who is the “the principal assistant to the Governor-General in all matters relating to the Department of Public Safety and Civil Defense.”

    The United States Supreme Court is the de facto court of last resort on Matters of Federal Law, be it Constitutional, Statutory, or Treaty. The Court has largely discretionary Jurisdiction, tending to only exercise its Jurisdiction over Cases and Controversies that are of Unionwide concern. The Supreme Court does not, however, have any Jurisdiction over Matters of State Law (Constitutional, Statutory, or Treaty) where there is no Federal question (e.g., where there is no alleged violation of the Constitution and Laws of the United States); in and for each State, on Matters of State Law the State supreme Court is the final Arbiter. Cases from this Court may be appealed to the Judicial Committee of the Federal Council; however, appeals to the Judicial Committee are rarely accepted, meaning that, in nearly every case, the Supreme Court has the last word.

    The United States Federal Court is both a Federal trial court and an intermediate Court of appeal that hears appeals from State supreme Courts and Territorial superior courts involving Matters arising under the Federal Constitution, Federal Law, or Federal Treaties. The Federal Court is an inferior court with Union-wide jurisdiction: However, the Court, while unitary, sits in each State and Territory as a separate division (called a “Circuit”) in its own right. Decisions rendered by this Court may be appealed to the U.S. Supreme Court. Furthermore, this Court, like all other Federal-level Courts, are prohibited from hearing Cases or Controversies involving the Constitution or Laws of a State, unless (and only unless) there is a Federal question. For Circuits of the Federal Court sitting in and for a Territory, these divisions effectively operate as the Territorial Supreme Court, as Territories are not sovereign and solely “exist to aid the United States in the enforcement of Federal law, and for limited local self-government; and to prepare the local population for Statehood” (Territories (Clarification) Act, 1730).

    Under section NUM, of the Judiciary Act of 1731, "[t]he federal Courts provided for in this section shall constitute a single Court, composed of all the duly elected or appointed judges in each of the States which may be included within the United States, and in like manner those in the Territory belonging to the United States.” In this sense, the single Federal Court of the United States of North Aegea is divided into fifty-six divisions called “Circuits”, conterminous with the thirty States, the twenty-eight Territories, and the two Districts. Officially, in the States, each Circuit of the Federal Court is styled the "Federal Court of the United States in and for the State of (State)", and for the Territories and Districts, the Circuit of the Federal Court therein is styled, "Federal Court of the United States in and for (Territory/District)”. For example, the Federal Court circuit located in the State of Arizona is officially the, “Federal Court of the United States in and for the State of Arizona”, while the Federal Court circuit located in Virginia Territory is officially the, “Federal Court of the United States sitting as the Supreme Court in and for the Territory of Virginia”; and the Federal Court circuit located in the Fœderal Capital Territory is officially the “Federal Court of the United States in and for the Fœderal Capital Territory sitting as the Supreme Court of the same”.

    The rules of procedure of the Federal Court are split fifty-six ways. This is because the Legislature of each State prescribes the rules of procedure not only for that State’s Court system, but also for the Federal Court division in and for that State; and the Federal government prescribes such rules for the Fœderal Capital Territory, District of Columbia, and the other United States Territories.
