Title 26. Emergency and Military Affairs
Chapter 1. Emergency and Military Affairs


ARTICLE 1. DEPARTMENT OF EMERGENCY AND MILITARY AFFAIRS
§ 26-101. Department of emergency and military affairs; head; appointment; compensation
  1. There is established a Department of Emergency and Military Affairs, which shall consist of a Division of Military Affairs, a Division of Emergency Management, and a Division of Administrative Services.
  2. There shall be a Secretary of the Department of Emergency and Military Affairs, who shall be the administrative Head of the Department.
  3. The Governor shall nominate and, by and with the Advice and Consent of the Senate, shall appoint the Secretary of the Department of Emergency and Military Affairs; and the said Secretary shall serve at the Pleasure of the Governor: Provided always, that no Person shall be appointed or otherwise serve as Secretary of the said Department who shall not, when chosen, be a Citizen of Arizona and been five Years a Resident of the same; and who, shall not, when chosen, have attained to the Age of thirty Years.
  4. The Secretary of the Department of Emergency and Military Affairs shall have as his principal Deputy a Senior Undersecretary of the Department of Emergency and Military Affairs, who shall be chosen and serve in like Manner as the said Secretary.
  5. There shall be an Adjutant-General, who shall be the ranking military Officer in the Department of Emergency and Military Affairs. The Governor shall nominate and, by and with the Advice and Consent of the Senate, appoint the Adjutant-General: Provided always, that no Person shall be chosen or otherwise serve as Adjutant-General who shall not, when chosen, have served in the Arizona State Guard and attained the rank of Colonel or higher; and who shall not, when chosen, have surpassed the Age of sixty-five Years. Failure to meet these qualifications shall terminate the appointment;—And, at the Time he enters upon the Powers and Duties of his Office, the Adjutant-General shall receive the Rank of Lieutenant-General and immediately become the ranking military Officer in the Department of Emergency and Military Affairs.
  6. The Secretary of the Department of Emergency and Military Affairs, the Senior Undersecretary of the Department of Emergency and Military Affairs, and the Adjutant-General, shall each receive compensation as determined pursuant to section 38-611; and the Secretary, the Senior Undersecretary, and the Adjutant-General shall each devote their full Time to their respective Offices.
§ 26-102. Powers and duties; head of department; general staff
  1. The Secretary, as Head of the Department, shall:
    1. Be the Administrator of the Department;
    2. Coordinate the Functions of the Divisions of Military Affairs, Emergency Management, and Administrative Services;
    3. Appoint, suspend, demote, promote or dismiss Employees of the Department, subject to the provisions of Title 38, chapter 36;
    4. Promulgate, with the approval of the Governor, Rules and Regulations which may be Necessary for the proper and effective Operation of the Department;
    5. Present to the Governor before each regular Session of the Legislature, or as otherwise required, an Estimate of the financial Requirements for State Monies for operation of the Department;
    6. Appoint, on the recommendation of the Governor and, by and with the Advice and Consent of the Senate, an Auditor for the Department. Said Auditor shall conduct periodic financial and compliance Audits of each Division and Office in the Department, and shall perform other Duties as prescribed by Law. No less than once annually shall the Auditor inspect and audit Accounts that are open for more than twelve Months. He shall determine within the Department compliance with purchase and bidding Procedures prescribed by Law;
    7. Establish and administer Accounts for Federal, State, or other Funds made available to carry out the Functions of the Department;—And
    8. Submit to the Governor, the President of the Senate, and Speaker of the House of Representatives, no later than September 1 of each Year, a Report for the Department for the preceding fiscal Year, including:
      1. The Strength and Condition of the Arizona State Guard;
      2. The business Transactions of the Department;
      3. A detailed Statement of Expenditures for all military and civilian Purposes;
      4. The disposition of all military and civilian Property on hand or issued;
      5. A description of the Activity in the camp Navajo fund established by section 26-152;—And
      6. A detailed Statement of the Arizona State Guard postsecondary education reimbursement program pursuant to section 26-181, subsection D.
  2. The Secretary of the Department of Emergency and Military Affairs, with the approval of the Governor, may:
    1. Enter into Contracts with Individuals, this State, political Subdivisions of this State, or the Government of the United States or any Department, Agency, Office, or Instrumentality thereof, for the Purchase, Acquisition, rental or lease of Buildings or military Materiel and take Title in the name of this State for the establishment and maintenance of Armories, subject to legislative Appropriation for these purposes;
    2. Procure and contract for Procurement of Equipment and its issuance to Members of the Arizona State Guard, or Members of the Militia inducted into the Service of this State;
    3. Enter into Agreements and Plans with any educational Institution for promotion of the best Interests of the Arizona State Guard and military Training of Students of the Institutions;
    4. Lease Property acquired under this Chapter for any public Purpose for a Period of one Year that is renewable;
    5. Convey for any public Purpose in the Name of this State easements on real Property acquired under this Chapter;
    6. Delegate the Powers and Duties in this Section;—And
    7. Adopt Methods of Security for the Arizona State Guard reservations or facilities that are consistent with the Constitution and Laws of this State.
§ 26-103. Department of emergency and military affairs; employees; fingerprints; exemptions; definition
  1. Employees shall submit the Form prescribed in subsection D of this section to the Department and, except as provided in subsection C of this section, shall submit a full Set of fingerprints to the Department of Emergency and Military Affairs and the Department of Public Safety for the Purpose of obtaining a State and All-Union criminal Records check pursuant to section 41-1750. The Department of Public Safety may exchange this fingerprint Data with the Fœderal Security Bureau or the All-Union Crime Information Center, or both.
  2. The Department of Emergency and Military Affairs may not disclose Information obtained pursuant to subsection A of this section except to Members of the Department’s Staff solely for employment Purposes.
  3. A Member of the Arizona State Guard or an Employee who holds a current security Clearance pursuant to the Laws and Regulations of the Arizona State Guard is exempt from the fingerprinting requirements of subsection A of this section.
  4. An Employee shall certify on a Form that is provided by the Department of Emergency and Military Affairs and Notarized that the Employee is not awaiting Trial or has never been Convicted of or Admitted in open Court or pursuant to a plea Agreement committing any of the Offenses listed in section 41-1758.03, subsections B and C in this State or a similar Offense in another State or Jurisdiction.
  5. The Department of Emergency and Military Affairs shall not allow a Person to be employed on any Arizona State Guard reservation or facility in any Capacity if the Person has not submitted a full Set of Fingerprints to the Department of Emergency and Military Affairs and the Department of Public Safety within the first three Days of employment for the purpose of obtaining a State and All-Union criminal Records check pursuant to section 41-1750.
  6. For the purposes of this section, “employee” means any Person who works for the Department of Emergency and Military Affairs or any subdivision of such Department.
§ 26-104. Undersecretaries and assistant secretaries; appointment; qualifications
The Secretary of the Department of Emergency and Military Affairs may appoint, on the recommendation of the Governor, and by and with the Advice and Consent of the Senate, such Undersecretaries and such Assistant Secretaries as may be Necessary for the proper and effective functioning of the Department.


ARTICLE 1.1. DIVISION OF MILITARY AFFAIRS
§ 26-111. Division of military affairs
  1. The Division of Military Affairs is established in the Department of Emergency and Military Affairs.
  2. The Division of Military Affairs shall consist of the Arizona State Guard, the General Staff of the Arizona State Guard, and such other Officers, Warrant Officers, enlisted Men, and other Employees, as deemed Necessary.
  3. The Division of Military Affairs shall be administered and controlled by the Governor as Commander-in-Chief: But there shall be an Undersecretary for Military Affairs who shall be the Head of the Division. The Adjutant-General, by virtue of his Office, shall be the Undersecretary for Military Affairs.
§ 26-112. Service components
  1. There shall be in the Arizona State Guard a service component army which shall be designated the Arizona Land Guard; a service component air which shall be designated the Arizona Air Guard; and a service component amphibious and expeditionary which shall be designated the Arizona Ranger Corps.
  2. In and for each of the service Components listed in subsection A of this section there shall be a Chief of Staff, who shall be the administrative Head thereof. The Governor shall nominate and, by and with the Advice and Consent of the Senate, appoint the Chief of Staff of each service Component, to a Term of four Years; and each of them shall serve at the Pleasure of the Governor. Each of them, upon entering on the Powers and Duties of the Office of Chief of Staff of their respective service Component, shall receive the Rank of Major-General, and shall be the ranking Officer in their service Component.
  3. Each service Component shall be organized, trained, equipped, disciplined, and maintained by the Chief of Staff thereof as directed by the Governor and the Secretary of the Department of Emergency and Military Affairs, in pursuance of the Constitution and Laws of this State.
§ 26-113. Powers and duties of undersecretary for military affairs as director of division of military affairs
The Undersecretary for Military Affairs as Director of the Division of Military Affairs shall be responsible to the Governor for the Execution of all Orders relating to the Militia; the Organization, including Activation, Re-Activation, Inactivation, and allocation of Units, recruiting of Personnel and public Relations, Discipline, and Training of the Arizona State Guard, and those Members of the unorganized Militia inducted into the Service of this State as provided in this Chapter
§ 26-114. Undersecretary for military affairs, principal deputy to the; appointment; qualifications; duties
  1. Of the Chiefs of Staff of the various service Components of the Arizona State Guard, the Adjutant-General shall designate one of them as his principal Deputy; another as his second Deputy; and the third as his third Deputy: And each of them shall serve as such Deputy and in such order at the Pleasure of the Adjutant-General.
  2. In the event that the Office of Adjutant-General becomes Vacant, by way of death, removal, resignation, incapacitation, absence from the State, or other Disability, the Powers and Duties of the offices of Adjutant-General and Undersecretary for Military Affairs shall devolve upon the principal Deputy; or, if there be no principal Deputy, the second Deputy; or, if there be no second Deputy, the third Deputy; until such Disability be removed, or until a new Adjutant-General shall be chosen and qualified.
§ 26-115. General staff; appointment; meetings; expenses
  1. There shall be a General Staff of the Arizona State Guard which shall be an advisory Board to the Governor in all military Affairs of this State.
  2. The General Staff shall consist of the Adjutant-General, the Chief of Staff of the Arizona Land Guard, the Chief of Staff of the Arizona Air Guard, and the Chief of Staff of the Arizona Ranger Corps.
  3. The Adjutant-General shall be Chairman and Chief of the General Staff.
  4. The General Staff shall meet at the Office of the Adjutant-General at least twice annually in January and July, and at such other Times as the Governor directs.
  5. All Records for the Transaction of military Business which requires Attention of the General Staff shall be kept in the Office of the Adjutant-General.
  6. Expenditures Necessary for Meetings of the General Staff shall be paid from Funds appropriated by the Legislature to the Arizona State Guard.
§ 26-116. Powers and duties of general staff
  1. The General Staff may promulgate Regulations which, in their Judgement, may be Necessary for the proper and effective Organization, Government, Armament, Equipment, Instruction, and Compensation of the Arizona State Guard and authorized Employees. Such Rules and Regulations shall be in Force and Effect when approved by the Governor. The General Staff may recommend the transfer, attachment, consolidation, or disbanding of any organization or unit of the Arizona State Guard for any cause.
  2. The General Staff shall recommend the principal Amount of Bonds to be given by Officers who have Property or public Money in their charge or possession. The Bonds shall be approved by and filed with the Adjutant-General.
  3. When Funds are available therefor by appropriation from the Legislature or by allocating from Federal funds, the General Staff may acquire by purchase or lease Lands for military Purposes, taking Title thereto in the name of the State.
  4. When the military Fund is sufficient, with the approval and by direction of the Governor, the General Staff may cause to be erected upon Lands owned by this State, Armories, drill Rooms, Headquarters, Offices or other Buildings for military Purposes; and may purchase and award Decorations, Cups, and Trophies of Marksmanship and Achievement through the Adjutant-General. The General Staff shall have control of Armories and shall prescribe the Regulations governing them.
  5. The General Staff shall:
    1. Act as military Advisor to the Governor and perform, as the Governor prescribes, military Duties not otherwise designated by Law;
    2. Adopt methods of Administration for the Arizona State Guard that are not inconsistent with the Constitution and Laws of this State;
    3. Supervise and direct the Organization, Regulation, Instruction, and other Activities of the Arizona State Guard;
    4. Attest and record all Commissions issued by the Governor and maintain a Register of all commissioned Personnel;
    5. Keep a Record of all Orders and Regulations pertaining to the Arizona State Guard and all other Writings and Papers relating to Reports and Returns of Units comprising the Arizona State Guard and Militia;
    6. Superintend the preparation of Returns, Plans, and Estimates required by this State, and by the United States Commissioner for Emergency and Military Affairs;
    7. Control the Use of and Care for, Preserve and Maintain all military Property belonging or otherwise issued to the State, and pay from Monies appropriated by the Legislature for these Purposes the Expenses which may be Necessary for Labor and Material incurred in the repair of military Property;
    8. Dispose of unserviceable military Property belonging or otherwise issued to the State, account for and transmit the Proceeds to the Morale, Welfare, and recreational Fund established by section 26-153;
    9. Authenticate with the Seal of the Department of Emergency and Military Affairs all Orders and Copies of Orders issued by the Office of Adjutant-General. An authenticated Copy has the same Force and Effect as the Original;—And
    10. Present to the Secretary of the Department before each regular Session of the Legislature, or as otherwise required, an Estimate of the financial Requirements for State Monies for operation of the Arizona State Guard.
